Why the Washington State Bar Association will be abolished

A couple of years ago, I decided to the best way to fight this massive racketeering organization, also known as the Washington State Bar Association, was to network with like minded open government residents.  One fact is clear, we can’t do it alone.

I can think of no better gift to leave behind than exposing corrupt government officials, forcing change where change is needed.

A few weeks ago, I heard my judicial hero, 9th Circuit U.S. Court of Appeals Justice Alex Kozinski, gave an interview to 60 Minutes reporter Lesley Stall.  I have been following many of Justice Kozkiski’s decisions, and each and every decision he writes I found myself agreeing with him.

In 2015, Justice Kozinski wrote a scathing opinion against King County Prosecutor Dan Satterburg and Mark Larsen’s deliberate withholding of evidence until after a person’s trial.  King County did this with the assistance of a career criminal/employee, Kelli Williams.

King County’s withholding of evidence to ensure convictions, making criminals out of non-criminals, was well stated by Justice Kozinski in the Joshua Frost decision.

The King County Prosecuting Attorney’s Office, violated a well settles rules requiring the disclosure of information material to the case “ by willfully withholding evidence of Shaw’s domestic-violence plea deal and permitting Shaw to lie on the stand… they kept Shaw’s plea agreement secret until two days after Frost was convicted even though they had been signed well before the start of his trial ” Kozinski wrote.

Kozinski also wrote “the prosecution’s tactic was deliberate, not an oversight.”

Anyone who has been dealing with any County in Washington attempting to seek access to public records knows one thing, the agencies have placed criminals inside to answer citizens public records request.


 

For me, Alex Kozinski represents “justice’ and the only reason why this single mother spent thirteen ( 13) years in higher education, while working as a machinist on 3rd shift.  Strangely, Alex Kozinski was appointed by President Ronald Reagan, a man I viewed as demented way before the press finally decided to report it.  My point in stating this is fact is that I was not a supporter of the late Ronald Reagan, but in fact casted my first vote against him.  However, I do admire him for appointing the Honorable Justice Kozinski to the 9th Circuit Court of Appeals.

Justice Kozinski was born to a Jewish family from Bucharest, Romania, in July 1950.  In 1962, when he was 12, his parents, both Holocaust survivors, brought him to the United States. The family settled in the Los Feliz neighborhood of Los Angeles, California, where his father, Moses, ran a small grocery store. Kozinski, who had grown up as a committed communist in Bucharest, became what he described as “an instant capitalist” when he tasted gum and bananas.

We Americans are all immigrants unless you’re native American.  That’s what makes America unique, but the best part of America is what Thomas Jefferson dragged back with him from Europe, the First Amendment.

The First Amendment guarantees freedoms concerning religion, expression, assembly, and the right to petition.  It forbids Congress from both promoting one religion over others and also restricting an individual’s religious practices.  It guarantees freedom of expression by prohibiting Congress from restricting the press or the rights of individuals to speak freely.  It also guarantees the right of citizens to assemble peaceably and to petition their government.

Hence why I admire and respect Alex Kozinski, as he understands that the First Amendment of U.S. Constitution’s provision of writing and speaking freely without interference is essential to any free society.  Without it, we are no better than China or Saudi Arabia.

At the center of rotten onion is the Washington State Bar Association monopolized by criminals withholding evidence to ensure convictions and to assist Association Washington Cities ( AWC) and the Washington State Attorney General’s Office with going after honest lawyers to limit liability.  It’s a racketeering organization controlled by free market participants like convicted frauders like attorney G. Geoffrey Gibbs ( see story below).

Interesting to note that G. Geoffrey Gibbs has been sued for racketeering six times. But instead of being disbarred like any criminal would be, Washington State illegally assigned him as a Commissioner Pro Tem and his law firm heads of the Snohomish County Public Defenders Association.  This to ensure Snohomish County’s racketeering scam is hidden from Washington State’s public disclosure laws.

This year We will have our first annual meeting, and are now linked up with like minded people in almost every county in Washington State.

We must do everything in our power to make sure criminals misusing our public offices are brought to justice regardless of the cost to ourselves.  Our children’s children deserve to live in a democracy free from corrupt government officials, not under Hitler’s regime.

UPDATE: It’s been a very long eight years to piece together why Gold Bar Washington is going broke hiding public records. . . this week, we finally have the missing link to the largest corruption scandal in Washington State history.

With no surprise, it involves former Washington State Attorney General “Sister Sara” Di Vittorio tampering with public records inside the Department of Corrections (DoC) and at Snohomish County Dept. of Emergency Management, according to a whistleblower who came forward last week “ Crystal Hill disseminated your Washington State Bar application and investigative file to John Pennington and Dept of Corrections employee Lonn Turner…”

But then the WSBA got involved in helping Geoffrey Gibbs and Seth Fine cover up their criminal racketeering conduct – quashing criminal sabotaging of the city’s water system as a favor to then Executive Aaron Reardon- a US Federal attorney, now working for the WSBA, was able to misuse her connections with the fusion center.

The racketerists herein illegally gained access into a “spider” of information on Block’s family members attempting to extort Block just like they did to former council member in 2007.  But by now, Crystal Hill ( convicted of bank fraud using an alias of Berg in 2005) had illegally possessed and disseminated medical files via Washington State emails in March 2009, the Washington State Bar to hide their criminal racketeering ( wire) crimes hired Scmipff to help conceal public records/files. Files that were illegally obtained ( without a warrant) and illegally disseminated via electronic means. Dissemination of medical files for a Mass residents is prohibited and is a federal felony, amounts to Rackeetering, punishable by 20-30 years in federal prison.

A file that Geoffrey Gibbs and Seth Fine both members of the Washington State Bar Boards in 2009 stole then disseminated the stolen file to Gold Bar’s then lawyer’s paralegal Barbara Johnson ( Weed Gaafstra, Benson) who then disseminated the stolen files to Crystal Hill, who then disseminated the stolen files to former Gold Bar council member Lonn Turner ( at LTurner@DoC.wa.gov) and disgraced Snohomish County political appointee John E. Pennington  (man responsible for the rape of a 5 year old child from Cowlitz County, Washington).

While working at the DoC, Sister Sara tampered with public records as a ” risk management” a felony in Washington State and certainly Racketeering.  According to a whistleblower, to wire crimes for high ranking WSBA members and disgraced former Washington State lobbyist G. Geoffrey Gibbs ( see below).

Unfortunately for the WSBA, Crystal Hill, John Pennington, Lonn Turner, G. Geoffrey Gibbs, and Sister Sara Di Vittorio, Gold Bar had a clerk ( who was caught via hidden camera stealing from Gold Bar resulting in her termination in 2012) who wasn’t sharpest tool in the shed. . .  it will be interesting to see if the Courts are going to help us abolish the WSBA or just simply reform it?

Everett attorney and WA State Bar Board member Geoffrey Gibbs caught red handed via public records filing false statements with Judicial Ethics Commission, and violating Sherman Anti-Trust to assist Snohomish County Prosecutor’s Office in going after any lawyer who exposes corruption involving attorney Geoffrey Gibbs, the criminals inside the WA State Bar ( Linda Eide, Lin O’Dell, and Doug Ende), and Snohomish County criminal Racketeering outfit (an RICO Enterprise operating from Snohomish County Judicial and Prosecutor’s Office).

In 2009, attorney Geoffrey Gibbs misused his political offices to assist Crystal Hill Pennington, John E. Pennington, Aaron Reardon, and Joe Beavers to cover up the Karl Marjerle sabotaging the City of Gold Bar’s water system.  Racketeering captured in public records.

Attorney Geoffrey Gibbs has been sued for Racketeering five times in the last two years for his criminal conduct.  An email from Everett Prosecutor Michael Fischer from G. Geoffrey Gibbs has  Gibbs sending an email to a Prosecutor demanding that he file criminal assault charges against Carolyn Ryggs so that she will have to expend a very large retainer to hire counsel. Because Gibbs was in a land dispute with the Ryggs after public records confirmed that was using Judge Michael Downes to steal Carolyn Ryggs’s land.

Now, Geoffrey Gibbs criminal Enterprise and public records confirm that Gibbs and Prosecutor Seth Fine are the main reason why Snohomish County yields over 40 % of disciplined lawyer inside the WA State Bar, while the highest populated county, King County ( Seattle) , only yields 12 %. According to our counsel, clear Sherman Anti-Trust violations; a federal felony.

We’re also working on a story linking the Klan to the ” Ok Boys Home” a story worth waiting for.

Just another stellar example of why the Washington State Bar will be abolished.

My step-grandpa in his later years was getting a little less coherent, when I was younger he was a very prejudiced man, he only loved one black man and that was Robert, but once a black family moved into the neighborhood he sold his house and built a new one in Valparaiso, in Sherwood Forest no less. Although I never once heard him use a derogatory term, the message was clear.

He owned the Hy-Speed car wash in Gary Indiana close to the Jackson home, yes as in the Jackson 5, Janet, and the creepy parents. I would go over and play with them and it drove my Grampa Joe nuts, he’d make me take a shower before I got in the car and I was never allowed to eat anything there or go inside their house.

One day when I was back home visiting I walked into the den and Grandpa was sitting there with the biggest smile on his face. He was watching Michael Jackson. I said Grandpa whatcha watching, he looked at me and said. This is a great country, do you know how I know that? I said no Grandpa I don’t. He points to the TV and said there is that little boy you used to play with. I said I know Grandpa but what does that have to do with anything? He said only in America can a poor little black boy grow up to be a rich white woman and then he smiled. As much as I didn’t like the message he had a point.

It’s like that with G. Geoffrey Gibbs, only in Washington can a convicted lobbyist, grow up to be on the Board of Governor’s and treasurer of the Washington State Bar Association, then become a Snohomish County Commissioner and get some of the most lucrative contracts in the county

Waste management would be foaming at the mouth if they truly understood the amount of trash just rolling around our county

George “G.” Geoffrey Gibbs. a lobbyist took many a politician, lawyer and judge on trips to Sunriver resorts, fishing trips in BC and on bus rides down to Jubitz Truck Stop/Ponderosa Lounge where having a hooker or a “lot lizard would simply be redundant. A reporter said as much but I checked with a former trucker and he immediately got embarrassed, turned red and told me to never go there. I’m going to take that to mean the reporter was telling the truth.

Looking at Pennington’s divorce records it shows that his then wife also complained to the courts that she has gotten a sexually transmitted disease from him 3 times during their marriage, I guess we know why now.

Remember, Pennington and Appelwick were “Dear Friends” since the 90’s

Washington State Bar violating Washingtonians civil rights, sued again

Washington attorneys, Steve Eugster, Robert Caruso and Sara Ferguson join our fight against the Washington State Bar, exposed again for corruption, violating constitutional laws of Washingtonians.  But this time, on behalf of all Washingtonians, as the Washington State Bar trying to rewrite the Washington State Bar Act.

The Certified Professional Guardianship Board develops, adopts and implements regulations governing certification, minimum standards of practice, training, and discipline of professional guardians, to protect the public and facilitate the delivery of competent and ethical guardianship services.

They are another “agency” that enjoys the protection of the Washington State Supreme Court, as a matter of fact the guardianship board has a member of the Washington Sate Bar Association on it. A woman named Barbara West.

The complaints against this woman have been piling up for years, but all the discipline board did was to put a letter of reprimand in her file

They did not address the fact that PF’s account had 4 million dollars but in just a few years she is down to less then 1 million dollars. None of the money went to care for her except for monthly stipends of about 1000.00 but many months she went without even that.

They did not address the fact that she “bought” one of her clients property for pennies on the dollar. A property she now lives at with her convicted killer of a husband.

Most disturbing is the fact that all they did was give her a letter when she had her husband caring for vulnerable people and threatening them.

This woman Lin O’Dell is still a hearings officer for the WSBA. A woman who steals from her clients, threatens them, lies to the courts on a regular basis is still a person standing in judgement of other lawyers.

The moral of this story is that you can lie steal and destroy others as long as you are under the protection of the WSBA & the Supreme Court. Also keep in mind that these 3 years of complaints they did nothing about are only the one’s they had to acknowledge, there were countless more that they swept under the rug. Last year the Gold Bar Reporter was first to break a story about a Washington State Bar Association Hearing Officer was found guilty of stealing from her client, using a convicted killer named Mark Plivilech to threaten and intimidate vulnerable and elderly disabled Washingtonians.

This story is an update on what the Washington State Bar Office of Disciplinary Counsel did as relates to countless complaints filed against attorney Lin O’Dell and her convicted killer boyfriend Mark Plivilech, after the Gold Bar Reporter exposed her racketeering crimes against Washingtonians.

Several Washington State Bar complaints have been filed against Lin O’Dell, which the Bar refuses to give us access to or even where those complaints are in the process. Let’s keep in mind that The Honorable Judge Monasmith already held that attorney Lin O’ Dell breach her ethical duties as a guardian, stole money and misappropriated trust monies by making payments to her convicted killer boyfriend Mark Plivilech.

One year after this story, hoping to that we could report that attorney Lin O’Dell is behind bars where she belongs. Sadly, we just learned from the Washington State Bar public records officer Nicole Gustine, Lin O’Dell is still serving as a hearing officer for the Washington State Bar Association.  A hearing officer hears ethical complaints filed against attorneys in Washington State. This two years after the Honorable Judge Monasmith, Stevens County Washington held that Lin O’Dell was guilty of stealing from her client’s trust account, and breach her duties to her client by misappropriating money to her convicted killer boyfriend.

As of today, the Washington State Bar Association Office of Disciplinary Counsel has taken no action against O’Dell, allowing her to continue stealing from our elderly.  But has in fact allowed Lin O’Dell to continue serving as a hearing officer  making decisions on complaints filed against other attorneys.

Rightfully we label Spokane County attorney Lin O’Dell as a thief, guilty of racketeering.

RICO and 1983 complaints have been filed against Lin O’Dell with more RICO and 1983 coming.  Knowing what was uncovered ( as detailed in the article below) that Lin O’Dell and her convicted killer Mark Plivilech are not yet in prison where they belong, the Gold Bar Reporter contacted the Washington State Bar Association two weeks asking them for a list of the hearing officers for the Bar as of today, and we were shocked and disgusted to know that the Washington State Bar Office of Disciplinary Counsel took no action against O’ Dell for her criminal racketeering conduct outlined below.

Since reporting on Lin O’Dell racketeering, we heard that several people filed complaints against her for the same reason, stealing from clients and threatening our elderly.

Governor Jay Inslee has yet to order a federal grand jury to investigate Lin O’Dell’s crimes against our elderly.

What should be noted from the above Washington State Bar Hearing Officers list is that each of the hearing officers are either Washington State government employees and/or engaged in the private practice of law. Keeping in mind that Washington State Bar Association keeps falsely asserting into court filings that they are a ” state agency.”

Perhaps the Washington State Bar cannot read RCW 36.27.060 prohibiting serving as a judge ( Hearing Officer) while at the same time engaged in the private practice of law.

The Washington State Bar’s turning a blind eye to thief Lin O’Dell criminal conduct as outlined below illustrates just how far the corruption in Washington State’s Bar Association has reached, extending up through our federal court system as well.

Attorney Lin ( Linda) O’Dell ( aka Worthington), an attorney handpicked by the Washington State Bar Association  (WSBA) Office of Disciplinary Counsel (ODC) to hear complaints filed against lawyers by clients ( non clients should have no forum) uses a convicted killer named Mark Plivilech to intimidate vulnerable adults, while she uses WSBA influence to continue stealing and depleting elderly clients trusts.

But O’Dell doesn’t do this alone, she gets a pass from the WSBA ODC.

Once Lin O’Dell and other attorneys involved in the same conduct as stated herein deplete the clients’ trust accounts, they place the client on Medicare and/or on the Medicaid system.

Our elderly deserve to die with dignity, and without the elite few WSBA members associated with the Office of Disciplinary Council and WSBA Boards lining their pockets with the gold of others, stealing with the assistance of a few Commissioners’ and Judges, at the expense of the United States taxpayers.

We have drafted a “Brady List” of Judges, Commissioners, and attorneys we know are involved in criminal conduct as outlined herein and will be posting names soon to our “ Brady List.”

Sadly, attorney Spokane attorney Lin O’Dell is not the exception, but she is part of the Racketeering scandal exposed over the past year involving what we call the center of the rotten onion, the WSBA ODC.

The WSBA ODC is using police officers, attorneys and judges to trump up criminal charges on honest hard working citizens and attorneys who speak out against corrupt government officials, and we ( Americans) must do everything in our power to peacefully and legally stop them. Their actions of going after honest lawyers and whistleblowers who attempt to expose corrupt judges, attorneys and police officers stifles our free market economy, and as in my case, violates Sherman Antitrust laws.

We the people are the checks and balances to an honest and clean government. As a person who grew up with two activist parents, who were no parents of the year by any stretch of the truth, I was brought up to believe there is no greater sacrifice or greater good on Mother Earth then helping the sick, elderly, abused, exposing corrupt government officials, and helping the wrongfully convicted. I value the First Amendment to US Constitution as the greatest gift Thomas Jefferson’s gave to America, more valuable than a Bar license.

Attorney Lin O’ Dell brags about her days as an administrative hearing officer for the Department of Health, she worked as a nurse and is now a guardian overseeing elderly clients trust accounts.

Lin O’Dell is not licensed in Idaho, only Washington. A relevant issue discussed later.

Does being a nurse or a guardian, especially one that has never engaged in the practice of law constitute qualifications under the WSBA guidelines for hearing officers?

Simply put, no.  I ‘ve researched the WBSA rules on appointing hearings officers and discovered that in order for the WSBA member to be appointed as a hearing officer one must have been engaged in the practice of law.  Here, Ms. O’ Dell appears to be the exception to this rule, since she never practiced law.

This begs the question on who appointed an unqualified attorney to hear issues relating to violation by WSBA members?

According to the WSBA public records officer, Ms. O’Dell was handpicked by another shyster from Spokane, attorney Joseph Nappi Jr. Mr. Nappi’s investigative file and his cash only deals with clients will be discussed in another investigative blog coming soon.


Attorney Lin O’Dell, using convicted killer Mark Plivilech to intimidate elderly vulnerable clients 

Now, on its face this may not seem too bad in the scheme of things, but lets add in this bit of facts.  Lin O’Dell’s background was searched extensively, and what we yielded was that she shacked up with a convicted killer named Mark Plivilech and extensive IRS and other financial problems.  YES our readers are reading this correctly; WSBA attorney and hearing officer Lin O’Dell’s partner of choice is a convicted killer.

If a WSBA hearing officer having a convicted killer as her partner of choice doesn’t sound bad enough, hold onto your seats because we have some more wonderful news.

According to internal court declarations and an extensive background check our investigators ran on Mark Plivilech, Lin O’Dell acting as a guardian for elderly vulnerable adults – many bed ridden elderly Americans- listed killer Mark Plivilech as a “case manager” on twenty (22) of her elderly clients’ accounts.

Once I learned that a convicted killer was acting as a case manager on vulnerable adults accounts, I called the Washington State Attorney General’s Office asking one simple question ” Can a convicted killer serve as a case manager on vulnerable or elderly Washingtonians trust account s or as a guardian ad litem?”

The Washington State Attorney General’s Office started laughing, for which I said  ” No, I am serious.”  The phone became silent for a minute and the attorney general said ” NO, absolutely not !” very loudly.

Court documents show that at the time of Norma Shank’s death, The Shank Trust had almost $4,000,000.00, at the end of 2011.

Paula Fowler is from Idaho, and how and why she came into contact with a thief and attorney named Lin O’ Dell can best be described by one of her closest friends who said ” Paula went into Colville attorney Pruitt Hamm’s office for a divorce, and came out with as a guardian ward. But not before Pruitt Hamm made exparte contacts with Lin O’Dell’s attorney in Idaho, Pamela Massey. Soon thereafter, Massey and O’Dell forged documents claiming that  Ms. Fowler’s mother, Norma Shank, had revoked the first Shank Will written in 2000, and only after Norma Shank was diagnosed with dementia, did this new Will appear with the assistance of attorney Lin O’Dell, attorney Richard Wallace, and Idaho attorney Paula Massey.”

We reviewed the both Wills and believe all attorneys involved should be charged with criminal Racketeering as the Will’s metadata has been stripped ( to hide when and who wrote it)


Exploiting and stealing from our elderly vulnerable adults

The only living Will of Norma Shank was signed in 2000, leaving her entire estate worth well over $5,000,000.00 to Paula Fowler, with no trust. No trust until after Paula Fowler went into attorney Pruitt Hamm’s office for a divorce and came as a guardian of Lin O’Dell, and only after attorney Pruitt Hamm made phone calls to an attorney from Idaho named Pamela Massey. An attorney hired by Lin O’Dell to help siphon elderly and vulnerable clients trust accounts through nursing homes in Spokane and drug rehab centers in Idaho.

Attorney Pamela Massey and Lin O’Dell were contacted for comment. As of today, both have refused.

According to attorney Pruitt Hamm’s attorney bills in the Fowler matter; no sooner did Paula Fowler leave Pruitt’s office seeking a divorce, Pruitt Hamm was on the phone with Idaho attorney Pamela Massey ( an Idaho attorney who represents Lin O’Dell).  Once Pruitt Hamm learned that Paula Fowler was worth well over $5,000,000.00, he conspired with attorney Lin O’Dell and Pamela Massey to steal from a vulnerable adult.

Over the last three years, attorneys Lin O’Dell and Pamela Massey have stolen over $3,000,000.00 + from Paula Fowler, but not without the assistance of the Washington State Bar lead counsel Linda Eide.

Court records from Pamela Massey’s Office in Idaho confirm that Lin O’Dell depleted non-Washington resident Paula Fowler’s trust accounts ( known as a Shank Trust, Wells Fargo, Idaho) to provide ” legal fees, at legal representation.”

There’s only problem for attorney Lin O’Dell, she is not an Idaho attorney.  Our counsel said ” a non attorney cannot provide legal representation without a license.”

From records we retrieved from Stevens County Court, in December 2011, the Shank Trust had $3,900,000.00 plus dollars in the account with no forensic accounting ever given to Ms. Fowler or the Court, even though Lin O’Dell was ORDERED to provide such documents to the Court by. A court order  Ms. O’Dell continues to thumb her nose at, while she continues to steal from Ms. Fowler but not without the assistance of the Washington State Bar lead counsel Linda Eide.

Not only did attorney Lin O’Dell write a check to Ms. Fowler’s soon to be ex-husband’s private attorney to defend against criminal felony charges for elder abuse of Ms. Fowler’s mother ( the one who started the 5 Million dollar trust for Paula Fowler also known as Shank Trust ), but Lin O’Dell uses Norma Shank’s trust account to write a $5000.00 check to attorney Clark Peterson, Idaho, and $250.00 to attorney Dick Sayre ( for a consultation, pretty harmless on Sayre’s and Peterson’s part more likely than not) to defend the man who was just charged with felony elderly abuse.

Washington State Bar Association hides its report on racism since 2007; “Let the sunshine in”

In 2007, a Seattle newspaper managed to obtain the Washington State Bar Association’s 2007 Report on Racism. When the newspaper published it, the Washington State Bar Association threatened to sue, forcing the little weekly newspaper to remove it or fight the Bar’s government racket.

The WSBA’s report below confirms beyond any shadow of a doubt countless articles published by the Gold Bar Reporter confirming that racism is alive and well in Washington State, and deeply embedded inside the Washington State Bar Association itself.

This report only solidifies our findings/reports that the Washington State Bar Association has placed attorneys inside Washington State agency as “risk management” as a way of stopping good attorneys from exposing the massive corruption, racketeering, Anti -Trust, and discrimination inside Washington agencies all over the state.

What should be noted is that when the Reporter requested a copy of this report from the Washington State Bar Association last year, the Bar untruthfully claimed that it did not exist. I always said ” at the center of the rotten onion is the Washington State Bar Association.”

The report stated that the Washington State Bar’s Board of Governor refused to take a stand against racism, probably because the Washington State Bar Association disciplined 80 % more minorities, thus is guilty of racism too.

The Board of Governors is the WSBA’s governing body directed by the Washington Supreme Court to determine the general policies of the Bar and approve its budget annually. The Board consists of the president, president-elect, immediate past president, members elected from each of the state’s congressional districts and three at-large members.

The Board meets seven times each year at locations across the state. Except for executive sessions, Board meetings are open to the public. The Board has several committees, and governors serve as liaisons to WSBA committees.

 

Robin Lynn Haynes | President (2016-2017)

Robin HaynesRobin Lynn Haynes is president of the Washington State Bar Association, the Bar’s youngest president to date. She was elected to the WSBA Board of Governors in June 2012, representing new and young lawyers. Since then, she has been active with the MCLE Task force and the MCLE Board, the Washington Young Lawyers Committee, the Committee for Professional Ethics, the Board’s Legislative Committee, and the Washington State Bar Foundation.

She practices employment and commercial litigation with McNeice Wheeler in Spokane and Seattle. She was previously the first woman partner at Reed & Giesa, P.S. in Spokane (2011), and spent two years as a litigation and employment principal at Witherspoon Kelley in Spokane.

Haynes is a past president of the Spokane County Bar Association’s Young Lawyer Division and a former board member for the Spokane County Volunteer Lawyers Program. In 2012, she was named the WSBA’s Outstanding Young Lawyer of the Year. She also is a founding Board member for the Washington Vets Will Clinic; a Moderate Means attorney; and an active member of Planned Parenthood’s Women’s Leadership Circle.

Finally, she is a “Triple Zag,” having earned her undergraduate, master’s, and law degrees from Gonzaga University, where she remains an active mentor.

 

Bradford E. Furlong | President-Elect (2016-2017)

 

Bradford E. Furlong is president-elect of the WSBA. He was elected to the WSBA Board of Governors in September 2013. He concentrates his practice on healthcare, municipal, real estate and land-use law. He is a member of the Washington Supreme Court Judicial Ethics Committee and teaches professional ethics for the WSBA. He is the Skagit County hearing examiner pro tem and has served as judge pro tem in both superior and district courts.

Furlong also serves as general counsel to Skagit Valley Hospital and Skagit Regional Clinics, the Port of Skagit County, and the Skagit County Public Facilities District. He has been town attorney for La Conner since 1988, city attorney for Anacortes since 2008, and general counsel for the North Sound Regional Support Network and the Skagit Land Trust.

He graduated from the University of Puget Sound Law School in 1982 after attending the University of California, Davis, and received his undergraduate degree in broadcast journalism from The Evergreen State College.

 

William D. Hyslop | Immediate Past President (2016-2017)

William-D-Hyslop William Hyslop is the immediate past president of the WSBA. He was elected president-elect in September 2014 and served as president September 2015–September 2016. He practices in civil litigation and dispute resolution for Lukins & Annis, P.S., in Spokane, where he is a principal. He has practiced for the firm since 1980, with the exception of 1991-1993, when he served as U.S. attorney for the Eastern District of Washington. An active member of Washington’s legal community, Hyslop has been involved in many WSBA activities and served on the Board of Governors in 2000–2003.

In 2006, he was awarded the WSBA President’s Award in recognition of his work in the Spokane community and service to the legal profession. He is a past president of the Federal Bar Association of the Eastern District of Washington and a former co-chair of the WSBA Committee on Public Defense. He is a past president of the Spokane County Bar Association and of the Washington State University Alumni Association.

Hyslop earned his law degree from Gonzaga University School of Law, a master’s in public administration from the University of Washington, and his undergraduate degree from Washington State University.

 

G. Kim Risenmay | Governor, District 1 (2015-2018)

WSBA Gov. G. Kim Risenmay G. Kim Risenmay was elected to the Board of Governors in September 2015. He is licensed in Washington as both an attorney and a certified public accountant. For nearly 30 years, he has practiced in multistate tax services for major law firms. He served as the state tax consulting partner for PricewaterhouseCoopers LLP in Seattle. Prior to that, he was a partner in the Seattle law firm of Bogle & Gates. He served as senior of-counsel attorney in charge of state and local tax services for the Seattle office of the Stoel Rives law from 2008 until 2014, when he opened his own boutique law firm in Redmond.

He has testified before the state Legislature, served on state-agency stakeholder committees to draft regulations, and taught for four years at the University of Washington School of Law.

Risenmay is a military veteran who began practicing law at age 34. He earned his J.D. from Brigham Young University’s J. Reuben Law School, where he graduated magna cum laude. And he received an LL.M in taxation from the University of Washington School of Law.

 

Rajeev Majumdar | Governor, District 2 (2016-2019)

Rajeev MajumdarRajeev Majumdar was elected to the Board of Governors in September 2016, replacing Brad Furlong, who now serves as the WSBA’s president-elect. Majumdar focuses his practice on civil litigation and business-oriented law at the Law Offices of Roger Ellingson, PS in Blaine, Washington.

He serves as prosecutor in jurisdictions including Blaine, Bellingham’s Mental Health Diversion Court, and the Nooksack Nation. As an adjunct professor at Western Washington University, he teaches rights, liberties and justice in America. He previously worked for the National Nuclear Security Administration in Washington, D.C., helping to establish protocols of cooperation between the U.S. and other nations to ensure the containment of weapons of mass destruction technology.

In 2015, Majumdar received the WSBA Local Hero Award for his work in improving public access to civil legal aid and advocating for homeless youth. He received his undergraduate degree in biology and philosophy from the Albertson College of Idaho; master’s degrees in international affairs and public administration from the University of Washington; and his law degree from Seattle University School of Law.

 

Jill A. Karmy | Governor, District 3 and Treasurer (2014-2017)

William D. Pickett | Governor, District 4 (2015-2018)

WSBA Gov. Bill Pickett William Pickett was elected to the Board of Governors in September 2015. He is a solo practitioner in central Washington, where he focuses his practice on trial advocacy in personal-injury and wrongful-death matters, civil rights and police misconduct, and medical malpractice. He is a frequent guest speaker on trial advocacy, police misconduct, and medical negligence issues. He is licensed to practice law in Washington, Oregon, and Alaska.

Pickett serves as an adjunct faculty member in the LL.M. Trial Advocacy Degree Program for Temple University School of Law. He is a member of the National Police Accountability Project, which monitors law enforcement misconduct across the country.

Born and raised in Yakima, Pickett received his B.A. degree in society and justice from the University of Washington in 1994, and his law degree in 1997 from Lewis & Clark Law School in Portland, Oregon. He later earned an LL.M. degree in trial advocacy in 2007 from Temple University James E. Beasley School of Law. Angela M. Hayes | Governor, District 5 (2015-2018)

WSBA Gov. Angela HayesAngela Hayes was elected to the Board of Governors in September 2015. She serves as in-house legal counsel for Associated Industries in Spokane, where, among other work, she provides training and advising on a variety of employment- and labor-related issues.

She previously was a managing partner of Randall & Danskin, P.S., where her practice areas included civil litigation, trust and estate dispute litigation, guardianship, and medical negligence defense. She has served on the WSBA Board of Bar Examiners since 2003 and was a trustee at the Spokane County Bar Association 2003–2005 and 2009–2011.

A Spokane native, Hayes earned her undergraduate degrees in English and communication at the University of Washington and a Bachelor of Science in nursing at Washington State University. She graduated summa cum laude in 1998 from Gonzaga University of School of Law.

 

Keith M. Black | Governor, District 6 (2014-2017)

Keith-M-BlackKeith Black currently serves as a pro tem hearing examiner in land use and environmental matters. A former law clerk for the Washington State Court of Appeals Division II, he was an associate at the Tacoma law firm of Gordon, Thomas, Honeywell; served under five elected prosecuting attorneys for Pierce County; and was appointed chief civil deputy, serving for 20 years in that position. Black is active with the Tacoma-Pierce County Bar Association, having served as its president, on its board of trustees, and on its editorial board.

He received his law degree from the Gonzaga University School of Law, where he was associate and senior editor of its law review.

 

Ann Danieli | Governor, District 7-North (2014-2017)

Ann-M-DanieliAnn Danieli was elected to the Board of Governors in September 2014. She has been an attorney in King County for more  than 30 years. She has served the public as a prosecutor, a public defender and a judge pro tem.

Danieli received her undergraduate degree from the University of California at Santa Cruz and her law degree from Seattle University School of Law.

 

James K. Doane | Governor, District 7-South (2015-2018)

James K. Doane James Doane was elected to the Board of Governors in September 2015. He serves as corporate counsel for Costco Wholesale, and previously was a partner at Preston Gates Ellis (now K & L Gates) for 15 years. He is a former chair of the WSBA Corporate Counsel Section and chair of the Diversity/Pro Bono Committee for the Association of Corporate Counsel, Washington Chapter. He also serves as vice-president and trustee of The Rainier Club.

Fluent in Japanese, Doane studied at Waseda University in Tokyo, and received his undergraduate degree in East Asian studies from Harvard University. He received his law degree from the University of Pennsylvania Law School.

 

Andrea S. Jarmon | Governor, District 8 (2014-2017)

Andrea-S-JarmonAndrea S. Jarmon was elected to the Board of Governors in September 2014. She is the managing attorney of Jarmon Law Group, PLLC, in Tacoma. Her practice focuses on criminal defense and family law, including representation of children and parents in dependency actions.

In addition to her law practice, Jarmon is an adjunct instructor at Green River Community College. She has previously served as an assistant attorney general for the Washington State Attorney General’s Office, a city prosecutor for Auburn and Seattle, and a full-time paralegal instructor.

She received both of her undergraduate degrees and her law degree from the University of Washington. She is a member of the Loren Miller Bar Association and the Tacoma Pierce County Bar Association.

 

Dan Bridges | Governor, District 9 (2016-2019)

Dan BridgesDan Bridges was elected to the Board of Governors in September 2016, when he replaced Elijah Forde as District-9 governor. Bridges is a partner with McGaughey Bridges Dunlap, PLLC. He has tried over 50 jury trials in state and U.S. District Court and argued more than 30 appeals in Washington Supreme Court, all three divisions of the Washington Court of Appeals, and the U.S. Court of Appeals for the Ninth Circuit. And he serves as a superior court arbitrator in four Washington counties.

Bridges received his undergraduate degree in political science from the University of Washington and his law degree from the University of Puget Sound (now Seattle University School of Law).

 

Christina Meserve | Governor, District 10 (2016-2019)

Chris MeserveChristina Meserve was elected to the Board of Governors in September 2016. She is a family law attorney and has been with Connolly Tacon & Meserve for 36 years. Her practice focuses on arbitration, divorce, custody and support, mediation, and prenuptial agreements. A former president of the Thurston County Bar Association, Meserve also served on the board of trustees of The Evergreen State College.

Meserve has served on the WSBA’s Judicial Recommendation, Character and Fitness, and Legislative committees. Early in her career, she was president of Washington Women Lawyers and served as its liaison to the WSBA Board of Governors.

She received her undergraduate degree from The Evergreen State College and her law degree from the University of Washington School of Law.

 

Athan Papailiou | Governor, At-Large and Treasurer (2016-2019)

Athan PapailiouAthan Papailiou was elected to the Board of Governors in September 2016. He is a litigator at Pacifica Law Group in Seattle. Before entering private practice, Papailiou served as a judicial law clerk for Washington Supreme Court Justice Debra Stephens. He also serves on the Board of Directors for the QLaw Foundation.

Papailiou received his law degree from the University of Arizona and undergraduate degree from the University of Oregon. As a member of UA’s Law & Behavior Research Group, Papailiou investigated the efficacy of jury instructions addressing the unreliability of eyewitness identification evidence.

 

Mario M. Cava | Governor, At-Large (2014-2017)

Previously, Cava was field counsel with the Law Offices of Sweeney Heit & Dietzler, and was a trial attorney at Associated Counsel for the Accused. He previously served on the WSBA Editorial Advisory Committee and was a member of the 2012 class of the Washington Leadership Institute.

Cava received his undergraduate degree in psychology and politics from Whitman College and his law degree from American University Washington College of Law.

 

Sean Davis | Governor, At-Large (2015-2018)

WSBA Gov. Sean Davis Sean Davis was elected to the Board of Governors in September 2015. He practices as a tort litigator for the Pierce County Prosecutor’s Office. Previously, he served as an assistant attorney general in Washington, practicing in the Torts and Labor and Industries divisions.

Davis was part of the 2014 Washington Leadership Institute, a program that recruits, trains, and develops minority and traditionally underrepresented attorneys for future leadership positions in the legal community. He serves as a captain in the United States Air Force Reserve, working in the legal office of McChord Field.

Born and raised in Tacoma, Davis received his undergraduate degree from the University of Washington and his law degree from the University of San Diego School of Law.

Our source, an insider close to Supreme Court Justice Barbara Madsen stated ” the WSBA is trying to come up with a plan to push liability off on Washington State taxpayers, because it’s clear that the Bar is going to lose Scannell v WSBA et al. and Block v WSBA et al. over felonious racketeering and anti-trust violations. ”

We just learned that Washington State Bar  Association has officially voted to drop the word association, in an effort to push liability of 50 Million plus onto Washington State taxpayers, instead of pushing liability to its’ members the above two cases.

In Block’s cases, public records from Snohomish County and the United States Post Office documented that John Pennington ( man who killed 43 people in the Oso mudslides, only suspect in the rape of 5 year old girl from Cowlitz County Washington, and is now working for Pierce College), set up a post office box in Duvall Washington to pass  financial bribes to attorney Lin O’Dell and her convicted killer boyfriend  Mark Plivilech, while at the same time, John Pennington is the  man, according to the lead detective on a Cowlitz  County case from 1992, the man who is responsible for the rape of a 5 year old girl.   Instead of suing Block, John Pennington enlisted his friend Linda Eide, Washington State Bar’s lead counsel, and Washington State Bar Board member Geoffrey Gibbs, to go after Block, a journalist who held a WSBA Bar license, for reporting on John Pennington criminal conduct.

In John Scannell ‘s case, Washington State Bar counsel members Scott Bugsby and Linda Eide tried to gain access into John Scannell’s attorney client files in an effort to go after a Board member’s political foe and Scannell’s client Paul King.

A source said ” The Bar knows that once you two win, you’re coming after them personall to collect damages, starting with members of the WSBA Office of Disciplinary Counsel.”

I attended the WSBA BOG meeting Friday in Walla Walla, having recently realized (through my work on theSections Policy Workgroup) that the BOG is now starting to implement a comprehensive series of sweeping changes to (i) the WSBA Bylaws, (ii) Court Rule 12.1 and to (iii) the Bar Act.

These changes are being implemented incrementally for tactical reasons, but are designed and intended ultimately to:

  • Substantially reduce the ability of Members to influence WSBA governance – in violation of the Bar Act,
  • Eliminate the WSBA’s role as its “Members” professional association,
  • Wholly and unambiguously convert the WSBA into a public entity/government agency with the singular and exclusive mission of serving the public, and
  • Enhance and expand the scope of the Washington State Supreme Court’s influence and control over all aspects of the WSBA (including setting Member dues), not just matters relating to licensing, regulation, attorney discipline and other such areas.

These changes are part of a longer term and little known Strategic Plan that is the product of these and other key WSBA leaders:

  • Executive Director Paula Littlewood,
  • Immediate Past President Anthony Gipe,
  • President William Hyslop,
  • WSBA General Counsel Jean McElroy

I then identified four of the proposed Bylaw Amendments most concerning to me:

  • First, I strongly objected to changing the name of the WSBA after 128 years to drop the word “Association,” emphasizing that this change is explicitly intended clarifythat the WSBA is not actually a professional association of attorneys. I said I thought most WSBA Members would find this highly objectionable and would be quite surprised to learn that they weren’t really part of a professional association for lawyers.
  • Second, I objected to putting the Washington Supreme Court in charge of determining members’ dues and said I thought others would too.
  • Third, I described the creation of three more appointed Board seats as undemocratic and bad from a governance perspective because appointed seats are subject to abuse by vesting too much power in the hands of too few. [Note: these changes to the BOG composition would also directly violate RCW 2.48.030of the Bar Act regarding the “Board of Governors.” The BOG is arguably illegally constituted currently based on that RCW.]
  • Fourth, I objected to giving limited license practitioners a greatly out-sized percentage of the Board seats relative to their de minimis numbers – i.e., 2 Board seats from a total of fewer than 20 limited license practitioners. [In my view, these folks should have to run within their Districts just like other Bar Members. At best they should be entitled to only a single designated seat.]

A reporter who was present at the Washington State Bar’s meeting said ” I added that I had read through the Governance Task Force Report twice in recent days and that I wasn’t too enamored with it, and that I had found much of its key analysis conclusionary and unpersuasive.”

He further stated “My comments stirred up quite a few folks, including current and former BOG members, several of whom said essentially that these issues had already been debated and discussed for a long time and that it was time to move forward with all of the recommendations in the Governance Report, including the first group of Bylaw Amendments under consideration.  These Governance Report recommendations have strong momentum. One gentleman even said he didn’t necessarily agree with the decisions made but that a lot of time and effort had going into them and it was time to start passing them because folks had done a lot of work and he wanted to see the results. So much for not being pushed into bad decisions by undue focus on sunk costs. ”

 

Mr. Gipe is currently running for King County Superior Court Position #52 – a position that could be the first step on a path to the Washington State Supreme Court, where he could ultimately exercise the control over the WSBA that he currently seeks to vest in that body. I personally feel it is very important to prevent this and thus to keep Mr. Gipe out of the judiciary. That is why I have gone to great lengths to support his opponent in the race. If you share my concerns…. Proposed Policies Eliminating or Restricting Religious (Cultural) Practices During the morning discussion of the WSBA’s proposed restrictions on religious practices, members of the Indian Law Section EC and many others from varied backgrounds advocated strongly that the Indian Law Section should be allowed to continue whatever religious and cultural practices they thought were appropriate, both for reasons of ensuring those who practice

Judge Ronald Leighton, carries a bible at his Pentecostal church which reads “corruption, the elite white man’s way” and when his law partner Stephanie L. Bloomfield argues in front of him she gets a outlandish 95 %  favorable ruling when Ronald Leighton is the judge.

With stats like this, who needs the courts, let’s play poker with a stacked deck.   This way, Stephanie L. Bloomfield ( Gordon Thomas and Honeywell) and I can fill our pockets with the gold of others.

Judge Leighton’s law partner Stephanie L Bloomfield is being sued for racketeering and Leighton refuses to recuse himself from the case in Blockv WSBA et al. A clear ethics violation but Judge Leighton, Ms. Bloomfield’s former law partner, believes he should not have to recuse himself from Block’s case.

Judge Richard Jones quoted at a WSBA meeting stating ” A black  person must jump higher than a white man” certainly in Judge Richard Jones’s court this is true as we could not find a single case in which Judge Jones ruled in favor of a minority since receiving a political appointment to the bench.

Strangely, when Geoffrey Gibbs was sued by the Carolynn Ryggs ( Ryggs v WSBA), Judge Jones recused  himself stating that he had a conflict, but less than one year later, he his conflict suddenly disappeared.

From Washington State’s Public Disclosure Office, we learned that Oprah Winfrey contributed to Judge Richard Jones campaign for King County Superior Court judge.  I am sure Oprah would be quite happy to know that her money went to support a judge who viewed himself closer to elitists’ than socially disadvantaged/disabled Americans.



 

In late 2014, the U.S. Supreme Court held that all organizations can be sued for Sherman Anti-Trust violations if the governing body is not monitoring it’s free market participants’. Unfortunately for the Washington State Supreme Court, it’s clerk (who has been removing and tampering with court files down in Olympia) Ron Carpenter, sent a citizen a letter basically stating that the Supreme Court does not monitor the Office of Disciplinary Counsel.

Just two examples of what happens to America when an uneducated bum like George Bush appointed two judges that either failed constitutional law or simple believe themselves to be above the law.

The unfortunate fact is that Judge Ronald B. Leighton remained on the REMANDED case after being ruled he abused his discretion for his FIRST ruling, and has AGAIN dismissed Scheidler’s case for the same reasons the 9th Circuit found as ABUSIVE!
Now Scheidler is claiming Judge Leighton, who is a Washington State Bar Associate, is making these abusive rulings because the defendants in Scheidler’s case are all Washington State Bar Associates, except James Avery and David Ponzoha. Of particular note is that Washington State Bar Associate, Karlynn Haberly, who served as Kitsap Superior Court Judge is at the center of the County’s fraud upon retired/disabled.
Scheidler has repeatedly asked Representatives Jesse Young, Michelle Caldier and Senator Jan Angel to address the corruption at the center of the Washington State Bar and the judges, who are Bar Associates, . They have all turned a blind-eye to the corruption and refuse to perform their constitutional duty mandated by Article 4, Section 9 – the REMOVAL of corrupt judges by the legislature!

Scheidler vows, irregardless of the outcome of his appeal, he will seek office and promise to perform all the duties a legislator , and or sponsor initiates to fulfill the express words of Article 1, Section 1 … “All political power is in the PEOPLE …. government officials ONLY have “JUST POWERS” by the CONSENT of the PEOPLE”.
Scheidler has filed such an initiative to REMOVE JUDGE KEVIN HULL for his corrupt and reprehensible conduct — of course Hull is a Washington State Bar Associate! This initiative is awaiting the Attorney Generals reply.

Fixing Cases: Pre-Determined Results in Washington Courts

This case study illustrates how insiders have by-passed public law and due process guarantees — and make justice in Washington State a mockery.

 

State Agencies Corrupt Public Law

In 2004, we were new to Washington and looking for a home. An agent from the biggest real estate firm in Washington — Windermere Real Estate — put together a home-purchase/renovation package for us. But the agent did not tell us the contractor he brought into the deal was his business partner, unlicensed and unqualified to do the work. The contractor ruined the value of the home; to add insult to injury, one of the subcontractors sued us, claiming he had not been paid. When we complained to the Department of Licensing (DOL) about the Windermere agent, DOL refused to sanction him. We then discovered other homeowners who had a similar story: Theyʼd been ripped off by Windermere agents, complained to DOL, and DOL looked the other way.

We asked Attorney General McKenna to file a Writ of Mandamus to compel the Department of Licensing to enforce the stateʼs real estate licensing laws. The AGʼs office (AGO) wrote back that the AG would go to court only to defend DOL against such a writ!

Huh? An Attorney General who defends a government agency that flouts the public law? One Hand Washes the Other

We testified before the Legislature about the situation homeowners faced in Washington. We wrote

letters to the House and the Senate complaining about DOLʼs preferential treatment of Windermere agents. We sent one such a letter to our senator, Rodney Tom, Chair of the Senateʼs Consumer Protection and Housing Committee and Vice Chair of the Judiciary Committee. Sen. Tom was not sympathetic towards us: He himself was a Windermere agent/associate broker!

Windermereʼs Rodney Tom was the Chair of the Senate Consumer Protection and Housing Committee? Isnʼt that like the fox guarding the henhouse?

Blowing the Whistle on Windermere and Its Government Cronies. We went to public events and shopping centers with signs and pamphlets warning the public about Windermere and the government corruption that protected it. We appeared on national TV: MSNBCʼs Undercover series, “The Homewreckers.” The show was broadcast nine times nationally.

At one point, Windermere offered us a settlement (for a fraction of the damages) and demanded an onerous secrecy agreement. Certainly Windermere regarded us as enemies and our activities has harmful to Windermere.

Getting Ready for Trial. If Only Weʼd Known …

We hired a young lawyer to take us to trial. He had just joined Lane Powell, one of the Northwestʼs largest law firms.

Unfortunately, we did not know the supervisor of the young manʼs practice group at Lane Powell was the Mayor of Bellevue, Grant Degginger — who at that time was presiding over Bellevueʼs biggest building boom ever. We did not know that the Washington Association of Realtors (“REALTORS”) was Deggingerʼs largest single election contributor (and every Windermere agent was required to be a member of REALTORS). Other development interests contributed to Deggingerʼs campaign, as did the Lane Powell law firm. That is, Lane Powellʼs Grant Degginger was beholding to the very interests we were opposing. Had we known any of this, we would not have engaged the firm. But no one told us.

During the course of litigation, we asked Lane Powell to tell the court about the malfeasance of DOL and AGO, but the firm refused. We later discovered that Deggingerʼs wife, a lawyer, had worked for AGO for 18 years …

Yes, the young man we selected scored a trial victory against Windermere. But during the course of trial preparation and subsequent appeals, Lane Powell bled our case for legal fees — and then gave away important awards. As soon as we could practically do so, we dismissed Lane Powell (August 3, 2011). By then, we had already paid the firm $313,808. On the day we dismissed the firm, Lane Powell filed a lien for an additional $384,881.66 plus interest against our upcoming Windermere judgment payout.

Two months later, on October 5, 2011 (before we received the Windermere payout), Lane Powell sued us for breaking our contract — and for the additional $384,881.66 plus interest — even though Lane Powell had promised in the contract not to demand the fees until after the Windermere judgment was paid.

“Judge Windermere” Assigned to Lane Powellʼs Lawsuit. If Only Weʼd Known …

The question before the presiding judge would be this: Would we, the Windermere victims, be the beneficiaries of our trial court win against Windermere? Or would Lane Powell be the beneficiary? If Lane Powell could absorb the lionʼs share of the award, a lesson would be taught the public: “Sue Windermere? Even if you win, you will lose.”

According to the King County Superior Court webpage, “A judge is randomly assigned by the clerk at the time of filing.” At the time Lane Powell filed its suit there were 32 (thirty-two) judges sitting on Bench.

Only one (1) was married to a Windermere agent/broker, enjoyed a marital share in the Windermere real estate commissions she earned, and was a beneficiary of the Windermere Retirement Plan.

That judge was Richard D. Eadie. And, SURPRISE! Lane Powellʼs lawsuit against two Windermere whistleblowers was assigned to Richard D. Eadie, the Windermere beneficiary. Against 32-1 odds …

From our very first pleading, we told Judge Eadie about our history as whistle blowers against Windermere and the corruption of the captive regulatory agencies. http://www.renovationtrap.com/ In violation of the Code of Judicial Conduct, Judge Eadie did not disclose his Windermere connections to us.

On the same day Lane Powell filed suit, it served discovery requests demanding we produce all communications we had with our attorneys on any subject whatsoever — not just matters pertaining to Lane Powellʼs lawsuit — thereby waiving all attorney-client confidentiality on all subjects. The message was clear: “Pay up, or your confidences will be published in court.” We believe thatʼs extortion under color of law. http://www.everyones-business.org/

Lane Powell told provable and repeated lies to Judge Eadie; when we provided documentation exposing the lies, Eadie simply ignored it and incorporated the lies in his rulings. He hammered us with one unfair decision after another. After ten months of this punishment, we found out about his Windermere connection and asked him to recuse (step down). He refused.

Extortion Under Color of Law. As for the confidences that Lane Powell threatened publish: Judge Eadie first granted, and then denied he had granted, discovery protection. Throughout, we refused to waive our attorney-client privilege. In defiance of the laws safeguarding privilege, Judge Eadie declared we were in

contempt of court for refusing to relinquish our confidential information and that, by refusing, we had stymied Lane Powellʼs case against us. He then used our refusal to waive our privilege to dismiss our defenses and counter claims. He held a Summary Judgment hearing on November 16, 2012, finding for Lane Powell. Four witnesses at that hearing swore out affidavits attesting to the Judge Eadieʼs obvious disregard for truth and prejudice in favor of Lane Powell. Ultimately, Judge Eadie awarded $842,734.67 to ex-Mayor Degginger and his colleagues at Lane Powell.

The message to other would-be Windermere whistleblowers? “Sue Windermere? Even if you win, you will lose.”

Who says cases arenʼt fixed in Washington?

We appealed Judge Eadieʼs refusal to recuse, using an excellent lawyer, James Lobsenz of Carney Badley Spellman, an expert on judicial recusal. The Court of Appeals misrepresented the issue on appeal, and then found against us — on the basis of its own misrepresentation. We then went to the Supreme Court. But even knowing that Judge Eadie kept his Windermere connections secret while hearing a lawsuit against two Windermere whistleblowers, that Lane Powell lied in court, that Judge Eadie had knowingly incorporated those lies into his rulings, and that the four citizens witnessed the judgeʼs prejudicial conduct during the Summary Judgment hearing — the Supreme Court refused to grant us an appeal. And Grant Degginger has been appointed to chair of the Public Disclosure Commission … It all passes for justice in the State of Washington.

We have filed a Complaint with the Washington State Bar Association — complete with more that 4,000 pages of documentation. (Synopsis at http://www.everyones-business.org/BarReport/Synopsis.pdf ) But WSBA will take no action, stating we have “insufficient evidence” of the misconduct.

To the Editor of the Skagit Valley Herald and to the good people of Skagit County:

 

 

 

This is the letter that will never be printed in the Skagit Valley Herald.  The Herald has written its story.  It was not the story that I would have written of course.  It is not even close to the story I would have written, but it is the story you, the citizens of Skagit County read on its pages.

 

Here is my letter to the Editor of the Skagit Valley Herald:

 

 

Not at any time have I been personally contacted before you published any of your stories regarding me and no one from your paper was in the courtroom the only time I have spoken.  I gave my story in an allocution statement.  It is on the record.  Reporting partial accounts or only what is handed to you as the full story gives the public a false impression.  Investigating matters appears to be no one’s strong suit.  Not the Skagit Valley Herald, not the Mount Vernon Police and not the WSBA.  All of which have a duty to investigate before acting.  By far a more compelling story would be why your newspaper was given this particular story and why you & I were given no exculpatory information that was clearly available to all of the investigating parties yet went unreported.   

 

I KNOW that I may hold my head high because I know that unlike some I have always dealt squarely and forthrightly in my dealings with other lawyers as well as members of the bench and of the public.  In doing so I stepped on toes.  I called it like I saw it and when I heard untruths I called a few liars, the was especially prevalent in Skagit County’s Ex-Parte Court.  When I saw repeatedly, guardianships being filed by the same people, lawyers who are & were tenant’s of the hospital lawyer, and as a creditor the hospital filing guardianships that gave preferential treatment to the hospital lawyer’s tenants and specifically requesting that his wife be appointed by the Court as the Guardian ad Litem, I spoke out.   

 

When that same Court appointed GAL did an extremely poor job, I spoke to her privately requesting that she specifically contact a health provider about the cancellation   of a much needed wheelchair for the alleged incapacitated person.  This GAL very flippantly told me not to tell her how to do her job and that her investigation was complete.  Even though I had just informed her that the woman’s care center had contacted me and needed this device to care for her properly.  At the time the only oversight was the Court.  Because of the GAL’s refusal to make this single telephone call a woman was left without support of a much needed medical device until her death.  

 

The GAL’s job is to investigate and make recommendations to the Court.  In refusing to investigate this necessary medical device’s cancellation she failed in her duty.

 

In zealously representing my client as well as being a mandatory reporter, I was required by law to point out this GAL’s errors and the only place to report it to was the Skagit Valley Probate Court.  After which I was threatened by the GAL’s husband, the  hospital lawyer, a now sitting member of the WSBA Board of Governors, who between clenched teeth told me “You’ll be sorry for this Rosemary”  after I did what was required of me by law to do.  Report the abuse of an elder in jeopardy.  By pointing out the gross failure of duty by the Court appointed GAL in her inept investigation the full abuse of the power and authority of the Washington State Bar Association disciplinary system was focused upon me for nearly ten years.  

 

To this day I stand by my assessment.  Now that very same GAL/wife, who did the worse report I read in over twenty years of practice, is in charge of overseeing complaints against GAL’s in three counties.  THREE COUNTIES!  Her own reports were questionable, yet now she is in charge of overseeing all GALs.  How does that happen?  Connections?  They know who they are.  They know what they have done.  

 

I’ve never filed a phony bar complaint.  

 

I’ve never gone behind anyone’s back by claiming to give NOTICE when I hadn’t.  I’ve never began a lawsuit against someone and failed to serve them to get a default judgment against them.  I’ve never had a default judgment entered when I knew the person was nearby and obviously could be served easily if service was attempted.  I’ve always gone straight to the person and I’ve always given others the opportunity to be heard.  

 

I’ve never given false testimony or had illegal Ex-Parte Orders entered.  

 

Twice I’ve had issues with an order.  The first time I had a problem with an order it came concurrent with a racially inspired conflict over an incident involving one of the co-director’s pushing and slapping my then ten year old son at play practice.  My son was acting in a local theatre company’s version of Peter Pan.  When my son who very much enjoyed acting and being chosen for a part told me he did not want to return to practice I discovered what had happened and personally went to the Director to specifically find out what led to the incident witnessed by a number of actors.  At the time this person apologized profusely and responded with all the politically correct sentiments but my son and I never felt welcomed again by that particular theatre group and for good reason, from then on we were hazed repeatedly by members of the cast and crew, invited and uninvited to cast parties, and I was 86’ed from backstage even though the job I had signed up to do from the beginning was to be the back stage gofer.  Not all of the cast but a good deal of you jumped on that band wagon.  You know who you are and you know what you did, and we know it too.

 

This Director and been appointed fairly recently as a Court Commission and it was his clerk who caused the problem with the order.  I clearly heard this man’s clerk tell me he had signed the order I had left earlier when ex-parte was overflowing.  I came back in the early afternoon, at which time I was told that the Commissioner had signed the oder .  When I asked for the original the clerk told me she had filed it in the Probate box at the Court Clerk’s office.  I conformed my copies and sent out the order to a local bank for action to be taken.  Late afternoon my office received a call from the Court Clerk indicating we had an order to be picked up.  This is when I discovered the order had not been signed and I immediately called and notified all parties.   At the time I was told it was an honest mistake.  Instead it became courthouse gossip.  Gossip over whether I had properly apologized to this Commissioner’s Clerk (who had told me that he had signed an order that had not in fact been signed.)  It amazed me because of the obvious distortions of the story to cover the backside of the person at the court.  They didn’t think I’d hear what was being said, and what was being said was far from the truth.  Instead she chose to lie and repeat that lie to anyone who would listen to her tale.  A lie that placed my reputation for honesty in question.  

 

The second incident came when this same Commissioner who had abused my son, and who had either instructed his clerk to say he had signed an order or whose clerk didn’t bother to ask him and then assumed he would sign it and told me he did so she did not have to say she hadn’t presented it to him, who knows; but this same Commissioner in another guardianship matter failed to ask what a “qualified plan” was when I presented to him that this guardianship was only necessary to distribute a single qualified plan.  Instead this decision maker pretended to know what one was when I specifically asked if he understood the taxing consequences of withdrawing funds from a qualified planned.  Had he simply admitted to not knowing the consequences of taxing qualified plans much of my later ordeal would have been avoided, but if there is one thing that most lawyers will never do – is admit that they are ignorant.

 

Courthouse gossip, like any untrue statements spread distrust of people and situations.  

 

We all are human so we all make mistakes.  Lawyers don’t like to be wrong.  Neither do Judges or those with the authority of Judges, like Commissioners.  

 

I have found that honestly pointing out these things to some in authority causes you great harm.  This I do not believe should be happening in our courts.  Honest, hardworking people should be able to get to the truth without our elected officials egos getting involved.  Without their perceptions, rather than the facts, being the reason for their actions or inaction.  As officers of the Court we are to rise above the pettiness, but when big egos get bruised they tend to retaliate in ways that they find available.  Often that is at another’s expense.  Retaliation at my expense has been very far reaching.  Thinking that by bringing someone else down they will regain what they perceive they have lost, or at least puff them up again has no place in our Courts and needs to be rooted out by voters.  It is my hope that the voters of Skagit County heed the call.  

 

Gossip is one of the tools bruised egos use to get their revenge and gossip is rampant in the Skagit County Court, and likely with many other courts as well.  However, when the powers that be allow courthouse gossip to flourish then everyone should be very aware that what they are doing can harm good honest hard working people.  Lying to cover up your own mistakes is just wrong, but doing it and then talking about people knowingly to put them in their place is maliciously passive aggressive, to knowingly harm another just  isn’t decent.  You know who you are.  You know what you have said and done.

 

Notice is a necessity under the law.  It is not at anyone’s discretion.  Entering default orders to force criminal proceedings where you know there was no criminal act is not only disgraceful but unconscionable by the bench.  Giving Notice to the Pioneer Board but not to me was an abuse of the power of your position and it is morally reprehensible that you would use your position to harm me because your ego got bruised when you butted into a guardianship matter that had never come before you.  Together you and the Commissioner conspired, assuming wrongdoing.  You were proven wrong in your perception.  You were given an opportunity to be heard and instead you conspired together to get me and you did.  It wasn’t enough to ruin my reputation, no that wasn’t enough for some of you.   So I’m gone.  I’m in jail.  You’ve made me appear to be what you are protecting.  There will be others to come after me who will not break under your bullying.  Others who are stronger than I am but like me will not compromise their principles or integrity just to avoid the wrath of a two-faced back stabbing witch.  There are other’s who won’t play the status quo ball either.  They are coming.  The good people of Skagit County need to know that there are honest, hardworking lawyers zealously representing them and making decisions, but that there are unconscionable, cold hearted, public employee parasites like you who should not be re-elected ever again due to your unethical use of the law and your blatant disregard for notice before you strike.  You cannot pretend to uphold the integrity of the legal system if you are one of the main problems.  You know who you are and you know what you have done.  Where is that story?  

 

Signing arrest warrants without probable cause after being asked for nearly twenty years to recuse yourself from all matters regarding me is obviously bias. Then ordering search warrants after the plea just proves the police had nothing, there was no probable cause for any criminal complaint, just a regurgitation of WSBA’s partial investigation, (because all exculpatory information was withheld by the very same WSBA that refuses subpoenas while asking for me to waive my confidentiality instead; then when I do so they claim their own confidentiality in my file.  Tell me, does the WSBA have confidentiality when it is a self governing body?  I know that the bar’s Executive Director Paula Littlewood never once used the word “transparency” when answering one of UW’s first year law student’s question as to what exactly does self governing mean.  

Obviously, self governing means never having to be accountable for the WSBA’s own errors, investigations, misrepresentations and Statements of Concern.)    

 

But, getting back to the point raised above, You sir, the Judge who signed my arrest warrant, you are a liar and always have been since I first dealt with you on a 1994 Estate. You know who you are and it does not surprise me that while sitting on the bench you think everyone before you is a liar, because you were a liar before the bench.  It is unfortunate that the people of Skagit County who vote have not seen your real side as I have.  Let’s hope you never run unopposed again for re-election. 

 

But then, you lied about my brother too, didn’t you.  You recanted your statement but only after he had been disbarred.  

 

Then there is another ex-parte liar who used your same allocations against my brother almost word for word against me in that previously mentioned matter where the Commissioner’s clerk told me an order had been signed.  First this Sheriff’s daughter admitted that it was an honest mistake, in writing.  Yet then she takes my brother’s complaint almost word for word and has her client file a phony bar complaint against me believing no doubt that I would be disbarred too.   Did your client tell you that he was investigated by APS, I wonder?  You think that because I called you out in ex-parte for lying to the Court that you should harm me?  You were the liar.  Not me.  You and your client who I reported because I am a mandatory reporter of abuse to elders in jeopardy.  You who the court appoints as guardian yet you barely do your job, but always proactively collect your fee.  You aren’t fooling me.  There’s no doubt you can fool the WSBA , you have friends in high places.

 

I complained because a GAL wasn’t doing her job, but she was never investigated by the WSBA, I was.  Why, because she encouraged the complaint and I relied upon the WSBA to do their job investigating the matter.  Often I was told by the bar investigator that if  anything, ANYTHING BY ANYONE,  was found to be an action for disciplinary proceedings it would be thoroughly investigated and the party would be disciplined, yet this derelict wife of a WSBA crony was never investigated.  So how is the bar protecting the integrity of the judicial system?  I informed them and gave them the information which is in the Skagit Court files, but the WSBA never got the files.  Instead, the WSBA let one of the people I specifically told my investigator about be a bar custodian of papers and complaints.  Yes, someone specifically pointed out as conspiring to harm another lawyer by making false statements and by withholding information was put in charge of disciplinary files as custodian in the years my case was being heard.  Was that because the WSBA ignores some complaints that should be investigated while dismissing others who provide favors or is it because the WSBA also fails to adequately investigate and is therefore derelict in its duty to us all?  It certainly isn’t protecting the integrity of the system as it’s mission statement implies.

 

On another note, the attorney witness for the prosecution testifying to excessive fees certainly is the pot calling the kettle black when one of you knowingly testified my fees were excessive after you charged over sixty thousand dollars in less than six months on a referral I gave to your old firm.  When I called to discuss it with you I was told you were no longer with the firm but had opened your own firm which I called and was told you were on vacation in Italy.  Bearing false witness is a sin.  Being a graduate of a number of Catholic Schools* you know that too.  You know you are the true crook and you testified against me out of spite.  Shame, shame on you, here’s to Dante’s Inferno not being fiction.

 

Just because lengthy probates with exorbitant fees is the way Skagit County has always done it doesn’t mean it is the way it should be done.  I taught people they could do living trusts and avoid probate.  This empowered the people and took their private family matters out of a mandatory court setting.  That is what the Trust, once executed, says to do and is the law everywhere but apparently Skagit County.  

 

Here instead of following what is written in the four corners of the trust document being the law, we have one ridiculous Judge who instead of using mediation as it is intended, goes around the trust to hire every beneficiary a mediator who is also a lawyer which defeats the purpose of the trust, stole from multiple charitable beneficiaries and is a violation and an abuse of the system.

 

Judges who make these type of decisions instead of honoring the four corners of the document are taking away the avoidance of probate designed in the revocable living trust and leaving the parties in the probate court where they never intended to be.  People beware.  This is happening here in Skagit County and it is only making some lawyers more wealthy and stealing from your estates.  

 

I was the messenger, I tried to warn the powers that be and discovered that some of the powers that be like the way things have always been done.  The people they socialize with reap the benefits. Under TEDRA this Judge appoints a mediator to replace every lawyer and takes these trusts through probate.  That is wrong.  They know it is wrong and they are doing it anyway.

 

Know that if you have a revocable living trust that upon your death it becomes irrevocable and anyone who wants to go to court IS CONTESTING the basic nature and  autonomy of that trust.  Don’t fall for anyone telling you that they are just clarifying the document or language and talk you into taking your trust to Court under TEDRA; you are being deceived by your lawyer and by anyone sitting on the bench who signs such an order.

 

You know who you are.  I named you in my allocution.  Its only time before you will be seen for what you are and people will see what you have done.  You haven’t won, this is to be continued for the sake of all the residents of Skagit County and all the creators of trust documents.    

 

I know what you have done, and are doing.  It is time the people of Skagit County know who you are and what you are doing.  

 

Anyone else may think what they like, however, I would ask the people who have met me and dealt with me personally as well as those who worked with me and who used my services if what they have read in the newspapers, what was given to the newspapers by the WSBA and certain other sources about  what has transpired involving me with & in the courts; – Does this at all go with your idea of the person that YOU know me to be?  The person who once had a stellar reputation, the one who sat across from you, spoke with you, counseled you, went to school with or picked strawberries or dug bulbs or waited tables with?  

 

If it doesn’t then ask yourself,  WHY?.   There is a story here and it isn’t me.

*Just to clarify to all you good Catholics in Skagit Valley.  The Arch Diocese of Seattle is running a Bank.  Your Catholic School Endowment was established to keep school funds out of the hands of the Arch Diocese in Seattle and here locally.  Over the past thirty years the Arch Diocese has done what it could to access the school’s endowment by controlling the funds.  This was never the intent of the Endowment.  The law suit filed against me by the lawyers of the Arch Diocese who made all kinds of nefarious & unethical allegations against me was heard in Federal Court and all of the allegations were by a preponderance of the evidence were found to be unfounded, but that did not stop any of you from believing the original lies and it cost the school payments on a convertible contract at a much higher interest rate than what the Arch Diocese was willing to give the school.  The Arch D has a conflict of interest with the school and forwarded their own agenda which cost the school dearly.  Whether you believe it or not.  The proof is in the baptismal font.  But for true guilty feelings over her false actions, frivolous lawsuit and likely the impending fear of all good Catholics, that of burning in hell; there would be no new baptismal font in Mount Vernon’s new church.  Omissions of truth are lies just the same and your money cannot wash away the origin you’re cowardice and lies have caused.   YOU know who you are and you know what you have done, and the rest of you don’t know the facts, but  certainly that hasn’t stopped anyone from talking and gossiping and drawing conclusions however inaccurate these may be.
